Sentencing Delayed for Hemp Truck Drivers

Boise (670 KBOI News) – Two drivers who pleaded guilty to hauling hemp in Ada County in 2018 — before it was legalized at the federal level — have agreed to put off their sentencing hearing.

CBS-2 News is reporting it’s not known when Andrew D’Addario and Erich Eisenhart may be sentenced…they face a possible five-year prison sentence with no possibility of parole.

An online petition gathered more than 21,000 signatures, asking Ada County Prosecutor Jan Bennetts to drop charges against the two, and Boise Representative Ilana Rubel has said their case is an example of why sentencing reform is needed in Idaho.

Rubel says if the men are convicted of doing something that’s now legal almost everywhere except Idaho, the judge would have no discretion to give them less than five years behind bars.

Denis Palamarchuk, the driver arrested in January for hauling three tons of hemp, has pleaded not guilty, and will go on trial later this fall.
